Under DSHEA, manufacturers are responsible for ensuring the safety of their products but are not required to prove efficacy before marketing them.

2. Safety Over Efficacy:
Regulatory agencies, such as the U.S. Food and Drug Administration (FDA), require that supplements be safe for consumption but do not mandate that they be proven effective. Manufacturers must ensure that their products do not contain harmful substances and that they are produced under good manufacturing practices. However, they are not obligated to conduct clinical trials or provide scientific evidence of the supplement’s benefits.

3. Structure/Function Claims:
Supplement manufacturers are allowed to make structure/function claims, which describe the role of a nutrient or dietary ingredient in maintaining normal bodily functions (e.g., “supports immune health”). These claims do not need to be backed by rigorous clinical data but must be truthful and not misleading. Any such claim must be accompanied by a disclaimer stating that the product has not been evaluated by the FDA and is not intended to diagnose, treat, cure, or prevent any disease.
